ESOS FRAMEWORK

Australia has a reputation as a safe, progressive and dynamic place to study; and we maintain this reputation by providing quality education and consumer protection specifically developed for overseas students.

The Education Services for Overseas Students (ESOS) Act 2000 and associated legislation is the legal framework governing the responsibility of education institutions towards overseas students. These laws set out rights and responsibilities of the overseas students. The Department of Education is responsible for administering the ESOS Act and its associated instruments.

Student’s rights

The ESOS framework protects your rights by ensuring the following:

  • right to receive information about the courses, fees, modes of study and other information from your provider prior to the enrolment.
  • right to sign a written student acceptance agreement with your provider before or as you pay fees, setting out the services to be provided, fees payable and information about refunds of course money.
  • your right to get the education you paid for. The ESOS framework includes consumer protection that will allow you to receive a refund or to be placed in another course if your provider defaults in providing the course.

The ESOS framework sets out the standards Australian education providers offering education services to overseas students must obey. These standards cover a range of information you have a right to know and services that must be offered, including:

  • appropriate induction and access to welfare services to help you study and adjust to life in Australia
  • situations in which  your enrolment can be deferred, suspended or cancelled
  • what your provider’s requirements are for satisfactory progress in the courses you study and what support is available if you are not progressing well
  • a complaints and appeals process.
  • One of the standards does not allow another education provider to enroll a student who wants to transfer to another course, but has not completed six months of the principal course of study you plan to undertake in Australia. If you want to transfer before hand you need your provider’s permission.

Student’s responsibilities

As an overseas student on a student visa, your responsibilities include:

  • Comply with student visa conditions at all times
  • maintain your Overseas Student Health Cover (OSHC) for the period of your stay
  • abide by the terms of the student acceptance contract with Pacific English Institute
  • inform Pacific English Institute change of address and contact details
  • maintain satisfactory course progress and attendance

OBLIGATION OF STUDENTS WITH SCHOOL- AGED DEPENDENTS

Students with school aged dependents, staying in Australia for more than 3 months, must enrol their dependents in either a State government or Private (non-government) school.  Most State Schools are free or provided at a minimal cost to Australian permanent residents and citizens.  Financial contributions are required by all people in Australia whom do not have permanent residency status and require their dependants to be schooled.

General English

  • There are no formal entry requirements for entry into the General English program

IELTS Foundation

  • In order to qualify for this course, prospective students must achieve a high Intermediate level on a pre-entry test or pass the General English Intermediate course.

IELTS Advanced

  • In order to qualify for this course, prospective students must achieve a high Upper-Intermediate level on a pre-entry test or pass the General English Upper-Intermediate course.

Pearson Test of English

  • In order to qualify for this course, prospective students must achieve a high Intermediate level on a pre-entry test or pass the General English Intermediate course.

TERMS AND CONDITIONS

No enrolment submitted by the applicant shall be accepted without a written confirmation of a placement by the Institute.
All tuition fees and other applicable fees must be paid prior to course commencement. Tuition fees may alter from time to time.
Any variation of the terms and conditions of this Contract of Enrolment must be in writing and be signed by the Institute Principal.
It is a condition of enrolment that the student attends all scheduled classes except where there is a legitimate reason for non-attendance which is acceptable to the Institute (for example, illness supported by a Doctor’s Certificate). If the enrolment is terminated due to a breach of this condition it is understood and agreed that there may be no entitlement to any refund of the tuition fees or other charges paid to the Institute under the Contract.
The student is required to use their best endeavours to meet the requirements of the Institute program selected and to abide by the rules and regulations of the Institute. In case of any breach of the Institute’s rules and regulations, the enrolment may be cancelled and there may be no entitlement to any refund of the tuition fees or other charges paid to the Institute under the Contract.
Course fees do not include the cost of textbooks, students will have to purchase these on commencement of the course.

Students are not required to be enrolled full time in their final semester where the students have been required to repeat units.
A student is not permitted to repeat a unit of study more than once.

COPYRIGHT

All lessons and any material related thereto supplied by the Institute are copyright and shall remain the property of the Institute.
Any unauthorised copying may constitute a breach of the Copyright Act 1968 (as amended).
Upon completion of the course, all Institute materials supplied to me shall be returned to the Institute.

CANCELLATION & REFUND POLICY

In line with the legislative provisions of the Commonwealth ESOS Act (2000), and in conjunction with the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2017 (the National Code 2017), Pacific English Institute (PEI) recognises that there are times when a student will require a valid refund of tuition fees paid in advance of study. OVERSEAS STUDENT HEALTH COVER (OHSC)

The Australian government requires all overseas students to pay for health insurance during their stay in Australia. Pacific English Institute staff will assist students in arranging this through the Overseas Students’ Health Cover Scheme (OSHC). The cost of OSHC for the 1-year course is A$512.50 (Single) and A$5,408.50 (Family). STUDENT SERVICES

The Institute reserves the right to change the particulars of the services, including changes of prices, courses, facilities, and dates of programs; where circumstances beyond the Institute’s control necessitate such changes or where the level of enrolments do not reach the minimum numbers required to operate a course viably.

GRIEVANCE POLICY AND PROCEDURE

In the event of a dispute between an individual student and the Institute, procedures are in place to facilitate the resolution of the dispute. Code of Conduct, Attendance, and Discipline.

Students are expected to abide by the terms and conditions of enrolment and the published rules and code of conduct of the Institute. Disciplinary procedures will be applied in the event of a breach of these rules. All staff are expected to apply the Institute’s policy and rules fairly and without favour, but if a student considers that this has not occurred, the student may refer the matter to the Academic Manager/ Director of the Studies.

If the student is dissatisfied with the decision or in the absence of a Director of Studies, he/she may ultimately refer the matter to the Principal for determination. Complaints and grievances must be submitted in writing using the Student Complaint Form and a written outcome of the result will be given to the student. Service and Academic Programs.

In the event of a student complaint concerning the quality of the service or teaching provided by the Institute, the student will report the matter to a person in a position of authority within the Institute. The complaint may either be dealt with by that person or referred to the Principal for resolution. The decision will be conveyed in writing to the parties.

Contractual and financial issues.

Matters relating to the interpretation of the contract, or the payment or refund of fees, are stated clearly in the Application for Admission. Any queries relating to course fees and other charges payable to the Institute will initially be dealt with by the Institute Finance and Administration staff. If the student is dissatisfied with the decision; the matter will be referred to the Principal.

This Agreement does not remove the right to take further action under Australia’s consumer protection laws. Any default by the Institute will be covered by the provisions of the ESOS Act and the ESOS Regulations.
